Mr. Miller is a Patent Attorney and holds a Bachelor of Science in Engineering from the New Jersey Institute of Technology and a Juris Doctor degree from the University of Dayton School of Law, Dayton, Ohio. During his attendance at the University of Dayton, Mr. Miller was a member and coach of the school’s Moot Court Team and won several awards for oral advocacy. Prior to merging with the firm of Clements Bernard Miller, Mr. Miller was a founding partner of the firm of Miller & Bernard, PLLC, where his practice included a concentration in the areas of patent and other litigation, as well as the prosecution of patent, trademark and copyright matters. Before relocating to Charlotte, Mr. Miller was a litigation associate with the law firm of Young & Alexander Co. LPA in Dayton, Ohio, where his practice specialized in trial law.

 

Representative cases:

Climb Tech, LLC et al. v. Reeves et al.- Mr. Miller is lead counsel over this patent infringement matter in the representation of certain Defendants.  This matter is still pending

Treestaple, Inc v. Border Concepts et al. – Mr. Miller acted as lead counsel over this patent infringement matter in the representation of the Defendants. This matter was resolved on favorable terms to the Defendants.


Buckshot, Inc. v. CCS/Austin Outdoors et al. – Mr. Miller acted as lead counsel over this design patent and trademark infringement case in the representation of the Defendants. This matter was resolved on favorable terms to the Defendants.


D. Mark Dunning d/b/a Mark IV Software v. J.A. Jones, et al. – Mr. Miller acted as lead counsel for the Plaintiff over this copyright infringement action relating to computer software.  This matter was resolved on favorable terms to the Plaintiff.

 

ASEG, Inc. v. Integrated Systems Design, LLC – Mr. Miller acted as lead counsel over this copyright infringement and contract litigation in the representation of the Defendant. The matter was resolved on favorable terms to the Defendant.


Katyna, Light and Design, Inc. v. Katyna, Light and Design, LLC – Mr. Miller acted as co-counsel over the prosecution of this trademark infringement and business tort litigation. This matter was resolved on favorable terms to the Plaintiff.


Kaman Music Corporation v. In-Jae Park, - Mr. Miller acted as counsel for the Applicant in a trademark opposition before the Trademark Trial and Appeal Board. The matter was dismissed in favor of the Applicant.

Solar Guide v. Micro Lens Technology – Mr. Miller acted as lead counsel over the defense of this contract litigation. The matter was resolved on favorable terms to the Defendant.
